1. Agreement to Terms

By accessing or using ReviewHQ NZ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ReviewHQ NZ provides a review management platform for New Zealand businesses. The Service includes email-based review request sending, review aggregation, AI-powered analysis, and social media sharing features.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have legal authority to bind your business
  • Notify us immediately of any unauthorised account access

4. Acceptable Use

You agree not to:

  • Send review requests to individuals who have not done business with you
  • Send spam or unsolicited commercial communications
  • Attempt to manipulate or fake reviews
  • Violate any applicable laws, including New Zealand's Unsolicited Electronic Messages Act 2007
  • Interfere with or disrupt the Service or its infrastructure
  • Share account access with unauthorised parties
  • Use the Service for any illegal or fraudulent purpose

5. Subscriptions and Payment

5.1 Pricing

All prices are displayed in New Zealand Dollars (NZD) and include GST. Current pricing:

  • Standard: $46 NZD per month
  • Professional: $69 NZD per month
  • Premium: $95 NZD per month

5.2 Free Trial

New accounts receive a 14-day free trial. No credit card is required to start the trial.

5.3 Billing

Subscriptions are billed monthly in advance. Payment is processed securely through Stripe. You authorise us to charge your payment method on each billing date.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial months.

6. Email Sending Limits

Each plan includes a monthly email sending quota. Unused emails do not roll over to the next month. If you exceed your quota, you may upgrade your plan or wait for the next billing cycle.

7. Third-Party Integrations

The Service integrates with third-party platforms including Google and various social media services. Your use of these integrations is subject to the respective platforms' terms of service. We are not responsible for changes to third-party platforms that may affect Service functionality.

8. Intellectual Property

The Service, including its design, features, and content (excluding user-provided content), is owned by ReviewHQ NZ and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our written permission.

9. User Content

You retain ownership of content you provide through the Service. By using the Service, you grant us a licence to use, store, and process your content as necessary to provide the Service. You are responsible for ensuring you have the right to use and share any content you upload.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by New Zealand law, ReviewHQ NZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and governing law survive termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
